• Section 513 of the Fair Work Act 2009 (the Act) provides that in deciding whether the official is a fit and proper person, the FWC must take into account whether the official has received appropriate training about the rights and responsibilities of a permit holder.  This course includes the right of entry provisions under Chapter 3, Part 3-4 of the Act, including:
• Reasons for entering a workplace
• Powers that can be exercised when entering a workplace
• Requirements for permit holders, including the need to return permits
• Prohibitions under the Act
• Entry permits, notices and exemption certificates
• Provisions of the Act pertaining to transport and accommodation
• Issues resolution in relation right of entry disputes
